PopCandi Inc. (“PopCandi") values the privacy of our users. This privacy policy ("Privacy Policy") outlines how we collect, use, store, and disclose information in relation to our business and services. By accessing our website and/or using our services, you agree to comply with the provisions of this Privacy Policy and our Terms of Service. Unless otherwise specified, capitalized terms have the meanings ascribed to them in the Terms of Service.

Please note that this Privacy Policy does not apply to the processing of information by third parties, unless otherwise stated. For instance, when users apply to a job notice, the Services may redirect them to an Employer's career site to submit an application. Information collected through such third-party sites is not governed by this Privacy Policy but instead is subject to the privacy policy of the respective third party. Similarly, information that users directly submit to a Coach is not covered by this Privacy Policy.

Users of Our Services

We provide our Services to various types of users, and the information collected from and shared about a user may depend on their user type. An individual may fall into one or more of these user types based on their interactions with our Services.

Member: An individual who utilizes our Services.

Author: An individual who creates content displayed on our website, including articles and posts.

Coach: An individual who offers PopCoaching through our website as a job coach.

Employer: An entity with a company profile on our website or that receives services provided by PopCandi.

Information We Collect

To fulfill our lawful business interests, including in connection with the provision of our Services, we collect certain information about users, including Personal Information. "Personal Information" refers to any information related to an identified or identifiable person, which may include a name, location data, email address, phone number, or other factors specific to a person's identity. We only collect information necessary to fulfill our lawful business interests and retain your information for as long as necessary to fulfill those interests. Personal Information may be combined with other information, and in such cases, we treat the combined information as Personal Information. We may also combine information collected through the Services with additional information collected by us or third parties in other contexts, such as our communications with you via email or phone, or our customer service records. In such circumstances, we handle the combined information in accordance with this Privacy Policy.

While you can visit our website and use certain Services without providing any information, including Personal Information, please note that choosing not to provide Personal Information may limit your access to or use of certain Services. As described below, we automatically collect certain information when you use our Services. The Services may also require you to provide Personal Information when registering as a Member, Coach, Author, or Employer. If you access our website through third-party social media platforms like LinkedIn, please review the Social Media Information section below.

Information about Members: We collect various types of Personal Information about Members in connection with the Services, which may include name, mailing address, email address, username and password, work and educational history, company and job title, photograph, resume information, content posted by Members, information about jobs applied for through the Services, location information, and payment information.

Information about Coaches and Authors: We collect various types of Personal Information about prospective and current Coaches and Authors, which may include name, mailing address, email address, phone number, username and password, work and educational history, company and job title, photograph, content posted by Coaches or Authors, and financial account information. Additional information may be requested to determine suitability for the Services, through means such as applications, telephone screenings, and reference checks. Certain information about Coaches and Authors may be made available to Members and/or the public for the purpose of providing the Services. We also collect and retain rating information provided by Members about Coaches upon completion of a Coaching Session.

Information about Employers: We collect various types of Personal Information about Employers, which may include name, mailing address, email address, phone number, username and password, content posted or submitted by Employers, and Personal Information of their employees. Certain Employer information may be made available to Members and/or the public for the purpose of providing the Services.

Applicant Information: We may receive Personal Information, including job applicant data, from Employers and applicant tracking systems, as well as through Employers' purchase of Services on your behalf.

Social Media Information: You have the option to log in to our website using third-party social media services, such as LinkedIn. If you choose to do so, we may collect Personal Information from the social media provider, including your username, email address, available profile information (such as public profile URL, profile photo, connections, industry, and location), and other information associated with your social media account. We require your consent before accessing our website through your social media account. By providing such consent, you represent and warrant that you comply with the terms governing those accounts and have the authority to provide us with information about your social media connections.

Surveys: We may request users to participate in surveys, contests, promotions, and sweepstakes, which may involve the collection of Personal Information. Participation in these activities is voluntary, and declining to participate will not affect your use of the Services.

Payment Information: When you purchase Services, we collect certain payment and billing information. You may also provide payment information collected through secure payment processing services.

Other information automatically collected: We collect information automatically through the Services. For example, it allows us to determine if a user has opened a particular email. Deleting or blocking cookies will not prevent the collection of information through pixel tags and similar tracking mechanisms. However, as discussed in the "Third-Party Analytics and Targeted Advertising" section, you can take measures to limit the use of such information for advertising purposes. Nevertheless, we may continue to use the information for other purposes, including analytics.

Local Storage: We may use HTML5 local storage to collect and retain certain information about you. Local storage data is not deleted when you clear your cookies, but you can delete it by following your browser developer's instructions.

Information collected on third-party sites: In some cases, we use the described mechanisms to track users when they navigate to and interact with third-party sites. For instance, we may use cookies, pixels, scripts, or other tracking mechanisms to identify when a user of our Services visits a business partner's website and applies for a job. This information allows us, among other things, to analyze how many applicants for a specific position discovered it through PopCandi. Although we do not disclose Personal Information combined with such tracking data to our business partners, we may provide de-identified information and analytics, as discussed in the "How We Share Information with Third Parties" section.

How We Use Information

We use the Personal Information we collect about users, including Members, Coaches, Authors, and Employers, for the following purposes:

- Providing the Services and customizing the user experience, tailoring the Services to individual interests and preferences.

- Fulfilling any agreements you have with us, responding to your requests, or completing transactions initiated by you, including payment processing.

- Reviewing, evaluating, and verifying the credentials and experience of Coaches, including screenings and reference checks.

- Posting job notices and other company information for Employers.

- Transmitting or redirecting Members' job applications to Employers.

- Communicating with users through email notices, newsletters, and updates, including promotional communications about topics, products, jobs, and Services we believe may be of interest.

- Administering surveys, contests, or promotions.

- Conducting analysis and research to enhance the quality of our products and Services, and improving user experiences.

- Complying with legal and/or regulatory requirements or protecting our rights and interests, as described in the "Legal Purposes" subsection of this Privacy Policy.

- Compiling and sharing aggregated information.

- Counting and recognizing visitors to the Services and analyzing their usage.

- Engaging in analytics or targeted advertising, as discussed in the "Third-Party Analytics and Targeted Advertising" section.

- Undertaking any other business purpose permitted by law.

How We Share Information with Third Parties

We may share information with third parties for various purposes. The following are the categories of third parties and the ways in which we share information:

Affiliates: We may share information, including Personal Information,with our corporate affiliates for the purposes outlined in this Privacy Policy.

We only provide these service providers with the information necessary to perform their services, and we work closely with them to ensure the protection and respect of your privacy. These service providers may collect and/or use your information, including Personal Information, to assist us in providing the Services and achieving the purposes stated in this Privacy Policy. Even if you do not interact with these plug-ins, they may collect information about you, such as your IP address, and may set and/or access cookies. The privacy policy of the respective company providing the plug-ins governs their use.

Other users of the Services: We may share information, including Personal Information, with other users of the Services when appropriate. For example, if you submit information to us or complete an application, we may share that information with an Employer who will evaluate your application. Likewise, we may share a Member's contact information with a Coach to enable direct communication.

Business partners: We may share your information, including Personal Information, with our business partners to fulfill your requests for the Services, complete transactions you initiate, or meet the terms of any agreement you have with us or our business partners.

Direct sharing of Personal Information: The Services may allow you to share Personal Information directly through the Services or via a third-party platform. For instance, Members may upload resumes or job histories to share with Employers through our website or post content or career-related questions on a forum. The Services may also provide a text-based or chat communication platform to connect Members and Coaches. Additionally, the Services may contain links to third-party websites with comment and social media features, including Facebook's "like" button and Twitter's "follow" button. By using these features, you may disclose your Personal Information not only to those third-party websites and services but also to their users and the public in general. As these third-party websites and services are not operated by PopCandi, we are not responsible for their content or practices. The collection, use, and disclosure of your information on such websites and services are governed by their respective privacy policies, not this Privacy Policy.

Legal purposes: We may use or share your information, including Personal Information, with third parties when we believe, at our sole discretion, that such action is necessary:

- To comply with applicable law, court orders, subpoenas, requests from government or law enforcement agencies, or other legal processes.

- To investigate, prevent, or take action regarding illegal activities, suspected fraud, or situations involving threats to our property or the property or physical safety of any person or third party.

- To establish, protect, or exercise our legal rights or defend against legal claims.

Third-Party Analytics and Targeted Advertising

We partner with certain third parties for analytics, auditing, research, and reporting purposes. These third parties may use web logs, pixel tags, or similar online tracking mechanisms and may set and access cookies on your computer or other device. For example, Employers may use pixel tags or scripts provided by PopCandi to track users who navigate to their websites and submit job applications.

The Services may also enable third-party tracking mechanisms to collect information about your usage over time and across unaffiliated websites for online behavioral advertising. These mechanisms allow third parties to target online ads for the Services to you on websites unrelated to PopCandi. Additionally, our third-party advertising partners may use information about your use of the Services to target advertisements that are not related to PopCandi, based on your general online behavior. The use of online tracking mechanisms by third parties is subject to their own privacy policies, not this Privacy Policy. We will retain Personal Information to the extent required by law, protect our rights and the rights of others, resolve disputes, enforce our legal terms or policies, or as permitted by applicable law.

Transfer of Information to the United States

The information we collect through the Services is transferred to and processed in the United States for the purposes described above. PopCandi may also subcontract the processing of your data to, or share your data with, affiliates or third parties in the United States or other countries. The data protection laws in these countries may differ from and be less stringent than those in your country of residence. Children's Privacy

The Services are not intended for children under the age of 16, and we do not knowingly collect Personal Information or other information from anyone under the age of 16. If you are under the age of 16, you may not use the Services under any circumstances.

PopCandi does not sell the Personal Information it collects and will not sell it without providing the right to opt-out.

Subject to certain limitations, the CCPA grants California users the right to request more details about the specific pieces or categories of Personal Information we collect (including how we use and disclose this information), to request the deletion of their Personal Information, and to opt out of any "sales" that may occur.

California users may exercise their rights under the CCPA by contacting us at contact@popcandi.com, and PopCandi will not discriminate against users who exercise their CCPA rights. We will verify your request using the Personal Information available to us, including your email address. Users may also designate an authorized agent to exercise these rights on their behalf.

We will notify you of any changes by posting an updated version online, updating the "Revised" date above, or sending you an email to the address you provided.
